CMFAS RES5 practice questions, with answers and explanations

Ten practice questions for CMFAS RES5 (Rules, Ethics and Skills for Financial Advisory Services), six on Part I and four on Part II, each with its answer and a worked explanation in English and Chinese.

We wrote these questions ourselves from the Singapore College of Insurance (SCI) study text, 1st Edition, Version 1.3. They are for practising the material and are not taken from any exam paper. Every explanation cites the chapter and paragraph it rests on, so you can check it against the text.

How to use these questions

Answer each question before you open its explanation. When you get one wrong, read why the option you chose is wrong, not only why the answer is right, then look up the paragraph cited.

The exam itself has 150 multiple-choice questions in 3 hours: 110 in Part I and 40 in Part II. You need at least 75% in Part I and at least 80% in Part II (CMFAS RES5 format, syllabus and fees).

The questions

Question 1

Part I, Chapter 1: Financial Advisers Act and Financial Advisers Regulations – Financial Advisers and Representatives

An exempt person must be able to show the Monetary Authority of Singapore (MAS) that it meets the fit and proper criteria. These are in respect of honesty, integrity and reputation; competence and capability; and which third area?

  1. Sales performance
  2. Length of time in business
  3. Financial soundness
  4. Number of representatives

Answer: C. Financial soundness

Why C: the study text names three areas in which an exempt person must meet the fit and proper criteria: honesty, integrity and reputation; competence and capability; and financial soundness. The criteria themselves are in the Guidelines on Fit and Proper Criteria, FSG-G01 (Ch 1 §6.3).

Sales performance, time in business and the number of representatives are not among the areas the paragraph names.

Question 2

Part I, Chapter 2: Financial Advisers Act and Financial Advisers Regulations – Conduct of Business

A licensed financial adviser knows that a client smokes. To get the client a lower premium, and intending to deceive the insurer, it writes "non-smoker" on the proposal form that is sent to the insurer. How does Section 43(1) of the Financial Advisers Act (FAA) treat this?

  1. It is allowed if the client agrees to it in writing
  2. It is prohibited: with intent to deceive, it has written on a form sent to an insurer a material matter that is false
  3. It is allowed if the adviser tells its own compliance department
  4. It is prohibited only if a claim is later made on the policy

Why B: Section 43(1) of the FAA says that no licensed financial adviser shall, with intent to deceive, write on a form given or sent to an insurer anything material to a proposed contract of insurance that is false or misleading in a material particular (Ch 2 §8.2). Whether the proposed insured smokes is material to the contract, and the form says something false about it.

A, C and D each add a condition the provision does not have. It carries no exception for the client's consent or for telling compliance, and it does not wait for a claim.

Question 3

Part I, Chapter 3: MAS Notices – Part I

Section 36 of the FAA requires a licensed financial adviser to have a reasonable basis for any recommendation on an investment product. In particular, it must give due consideration to which three things about the person?

  1. Age, occupation and nationality
  2. Past investment returns, tax status and employer
  3. Income, marital status and number of dependants
  4. Investment objectives, financial situation and particular needs

Why D: Section 36 requires a reasonable basis for any recommendation on an investment product made to a person who may reasonably be expected to rely on it. In particular, the adviser must give due consideration to that person's investment objectives, financial situation and particular needs (Ch 3A §1.13).

The items in A, B and C may come up in a fact-find, but they are not the three things the section names.

Part I, Chapter 5: MAS Notice No: FAA-N06 – Prevention of Money Laundering and Countering the Financing of Terrorism

Under MAS Notice FAA-N06, a financial adviser must identify each customer. Which of the following is among the information it must obtain, at least, to do so?

  1. The customer's full name, including any aliases, and a unique identification number
  2. The customer's annual income and net worth
  3. The names of the customer's family members
  4. The customer's investment experience

Income and net worth, family members' names and investment experience are not on that list.

To help it monitor switching that may be detrimental to a client's interests, what should a financial adviser require the client to do?

  1. Wait for a fixed period before buying the replacement product
  2. Obtain approval from MAS before switching
  3. Declare in writing whether a representative of the financial adviser advised him to dispose of, or reduce his interest in, an original product to acquire a replacement product
  4. Pay a fee to the financial adviser for the switch

Why C: so that it can monitor switching that may harm a client's interests, a financial adviser should require the client to declare in writing whether one of its representatives advised him to give up or reduce his interest in an original product in order to acquire, or increase his interest in, a replacement product (Ch 9B §1.10).

The paragraph asks for a written declaration. It does not set a waiting period, an approval from MAS or a fee.

  3. He may pass the information to a friend, provided he does not trade himself
  4. He may trade in its securities once he has told his employer about the information

Why B: a person with inside information on a corporation or its securities must not enter into transactions in those products, and must not communicate the information to other parties (Ch 12 §8.5).

A is the trap: it does not matter that he had no intention of using the inside information (§8.5). C is wrong because passing the information on is itself prohibited. The paragraph gives no exception for telling an employer, so D is wrong.

A representative would earn a higher commission by recommending Product X, although Product Y suits the client better. What is this situation an example of?

Why D: a conflict of interest is a situation in which the aims of two persons are different or incompatible, where a person is in a position to gain personally from his own actions or decisions (Ch 16 §3.8). Here the representative's gain from the higher commission pulls against the client's interest, and the incentive tempts him to act against that interest (§3.9).

Nothing in the facts says that he has disclosed confidential information or made a false statement, so A and B do not fit. C names a duty, not the situation described.

Why A: the five fair dealing outcomes are that clients have confidence that fair dealing is central to the institution's corporate culture; that products and services are suitable for their target clients; that representatives are competent and give quality advice and appropriate recommendations; that clients receive clear, relevant and timely information; and that complaints are handled in an independent, effective and prompt manner (Ch 19 §5.12). A is the fifth.

None of the five speaks of a fixed return, the lowest fees or offering every product in the market.

A representative is taking a client through the Life Insurance Advisory Form. The client does not want to provide some of the information required. What must the representative do?

  1. Fill in an estimate on the client's behalf
  2. Leave the section blank and make no record of why
  3. Clearly document the client's decision
  4. Ask a colleague to obtain the information from the client's employer

Why C: where a client does not want to provide the information required, the representative must clearly document that decision (Ch 22 §3.6).

A puts the representative's guess in place of the client's information. B leaves no record, which is the opposite of what the paragraph asks. D goes around the client's own decision.

Observing adds to listening; it does not replace asking questions or the client's own input, so A and D are wrong. C confuses observation with identifying the customer, which is a separate matter.
